February 1, 2019 – Defending the Second Amendment
What is the problem?
It didn’t take Democrats long after taking over the House majority to begin their mission of overturning the Second Amendment. On January 8, 5 days into the new Congress, they introduced H.R.8, to require a background check for every firearm sale.
Why is this a problem?
Gun control advocates claim that “universal” background checks are necessary to stop dangerous people from obtaining firearms. However, federal laws and regulations already prohibit these individuals, such as felons, fugitives, and domestic abusers, from obtaining firearms. Under current law, all firearms dealers are required to be licensed and to run background checks before transferring a firearm to a non-dealer, regardless of where the transfer takes places.
According to the Department of Justice, 77 percent of criminals in state prison for firearm-related crimes and 79 percent of criminals in federal prison for firearms crimes got their firearm through illegal means. Criminals don’t abide by the laws! Instead of doing more to protect our communities, H.R.8 will add another layer of unconstitutional bureaucracy on law-abiding gun owners.
What is H.R. 8?
H.R. 8 subjects ordinary, law-abiding citizens to potential federal criminal penalties for transferring a firearm to another person without using a licensed firearms dealer. Again, current law already prohibits private sales without a background check if the seller has any reason to believe the person may be dangerous. Unfortunately, this bill will make criminals out of responsible gun owners and heavily infringes on our second amendment right.
Some gun-related tragedies and crimes are preventable, and we should do everything we can to ensure that they are prevented. However, instead of efforts to undermine the Constitution, we should improve cooperation between law enforcement agencies and ensure dangerous criminals are prosecuted to the fullest extent of the law. These efforts could save lives.
What am I doing about it?
When I took my oath of office, I swore to protect and defend the Constitution of the United States of America. This does not exclude the Second Amendment. I will oppose any of the Democrats’ attempts to infringe on our Second Amendment rights, including H.R. 8.
