GOP Rep. Biggs: Legal Expert Came In With 'Reckless Bias'

Rep. Andy Biggs, R-Ariz, took legal expert Noah Feldman to task in Wednesday's House Judiciary Committee impeachment hearings for his 2017 tweet arguing for President Donald Trump's impeachment.

"The expansive view you have of impeachment is a real problem," Biggs said.

"What I'm suggesting to you today is a reckless bias coming in here. You're not a fact witnesses. You're supposed to be talking about what the law is, but you came in with a preconceived notion and bias."

Feldman, a Harvard Law School professor, in 2017 argued that Trump's accusation that former President Barack Obama wiretapped his phones "could get the president impeached."

"When President Trump accuses Obama of an act that would have been impeachable and possibly criminal, that's something much more serious than libel. If it isn't true or provable, it's misconduct by the highest official of the executive branch," Feldman wrote in a piece for Bloomberg at the time.

"How is such misconduct by an official to be addressed? There's a common-law tort of malicious prosecution, but that probably doesn't apply when the government official has no intention to prosecute. The answer is that the constitutional remedy for presidential misconduct is impeachment."
